Announcement of the Vice-Rector for Education of Lodz University of Technology on contracts for services provided to Lodz University of Technology and their implementation as of June 1, 2020

Announcement issued on the basis of issued on the basis of Ordinance No. 21/2020 of the Rector of TUL of 9 March 2020 on special measures related to the prevention, counteraction and combating of the COVID-19 virus at Lodz University of Technology

§ 1

1. Heads of autonomous organizational units of Lodz University of Technology (Deans, Directors of All-University Units), in relation to the units subordinate to them, and the Chancellor, in relation to commitments entered into by the Rector's, Chancellor's and Bursar's administrations, shall assess the impact of the circumstances related to the occurrence of SARS‐CoV‐2 on the performance of agreements entered into by Lodz University of Technology pursuant to the Public Procurement Law and the Regulations on Public Procurement at Lodz University of Technology and executed in the units, and based on the provision of Art. 15r and others of the Act of 2 March 2020 on special solutions related to the prevention, counteracting and combating of COVID-19, other infectious diseases and crisis situations caused by them (Journal of Laws 2020, item 374 as amended), hereinafter referred to as the Special Act, shall decide to amend the agreements, in particular by:

a) changing the date of execution of the agreement or its part, or temporary suspension of execution of the agreement or its part,

b) changing the way supplies, services or works are performed,

c) changing the contractor's scope of performance and modifying the remuneration or the method of settling the contractor's remuneration, provided that the increase in the remuneration resulting from each subsequent change does not exceed 50% of the value of the original agreement.

2. The assessment referred to in paragraph 1 is made in each case on the basis of an individual assessment of the occurrence on the part of the Ordering Party or the Contractor, during the performance of the agreements, of the provisions of the Special Act and the contractual provisions in the scope of circumstances entitling to amend the agreement, related to COVID-19, as well as taking into account the impact, if any, of the performance of the agreement on the functioning of the unit, in which the agreement is performed and possible threats to the employees of the unit.

§ 2

The Announcement enters into force on 1 June 2020.
